Overview

Tether (USDT) is the world’s largest stablecoin by market capitalization (~$120–140B in mid-2025), issued by Tether Ltd., a company registered in the British Virgin Islands with operations historically tied to Bitfinex exchange. It is a dollar-pegged payment instrument — a redemption claim on USD held in Tether’s reserves — and is the dominant settlement asset in global crypto trading. Tether occupies two roles simultaneously, and the wiki should hold both honestly rather than picking the framing of either side’s lobbyists:

  1. Compliance problem. Tether has had documented reserve attestation issues, settled with the NYAG ($18.5M, 2021) and CFTC ($41M, 2021) over reserve misrepresentation, and operates outside U.S. regulatory perimeters. Senate Banking Committee Democratic staff (whose framing is partly informed by Circle’s commercial interest in displacing USDT) called it “the new kingpin of illicit crypto activity.”
  2. Dollar export infrastructure. Tether is the de facto dollar in Argentina, Turkey, Nigeria, Lebanon, Venezuela, and Russia-adjacent commerce. Hundreds of millions of users in capital-controlled or failing-currency economies use USDT to hold dollar value when their domestic banking systems block direct USD access. Tether holds more U.S. Treasuries than Germany — that is not a paradox, it is the entire point. Why these two views describe the same product: the “financial crime vector” framing and the “dollar-access tool” framing differ on whose monetary sovereignty you are counting. To the U.S. Treasury and Senate Banking Democrats, USDT routing around BSA/KYC/sanctions perimeters is a compliance problem. To an Argentine saver whose peso has lost half its value, USDT is the only available product. Both descriptions are accurate.

The GENIUS Act created what critics call a “Tether loophole” — allowing offshore issuers to continue trading on U.S. decentralized exchanges. But “closing the Tether loophole” is, in operational terms, code for transferring Tether’s user base to Circle — which is impossible because Circle (as a U.S.-regulated entity subject to OFAC) cannot serve the dollarized-economy users for whom KYC/AML perimeters are themselves the access barrier. This is the structural feature of the situation that the DC framing misses.

The crypto-Twitter framing (“Tether is fine, leave it alone”) is laundered Tether PR. Neither captures the structural fact that USDT is the most effective dollar-export product the United States has ever built — and that the regulated U.S. alternative is operationally incapable of replacing it because the regulatory perimeter (KYC, AML, sanctions screening) is exactly the barrier dollarized-economy users are routing around.
