Overview

Patrick J. Schiltz is the Chief U.S. District Judge for the District of Minnesota. During Operation Metro Surge he produced the documentary record of ICE’s defiance of the federal courts — first finding that ICE had violated 96 court orders in 74 cases, then, after the U.S. Attorney accused the court of inaccuracy, ordering a re-verification that confirmed the count and added 113 more violations, bringing the documented total to roughly 210. His orders contain the sharpest judicial language on record about the operation.

Key Facts

  • The findings came in an individual habeas case, Juan T.R. v. Noem, No. 0:26-cv-00107 (PJS/DLM)not the high-profile state suit to halt the operation (that was State of Minnesota v. Noem, before Judge Katherine Menendez). Prior wiki notes conflated the two; this is the correction.
  • Jan. 28, 2026 (ECF No. 10): canceled a contempt show-cause hearing for Acting ICE Director Todd Lyons after ICE released the detainee, but attached an appendix documenting “96 court orders that ICE has violated in 74 cases” since Jan. 1, 2026 — and called the count “almost certainly substantially understated.”
  • Feb. 26, 2026 (ECF No. 12): after U.S. Attorney Daniel Rosen (Feb. 9 email) called the finding “far beyond the pale of accuracy,” Schiltz had other judges and his clerks re-verify: 97 violations in 66 cases confirmed (Appendix A), plus 113 additional violations in 77 additional cases (Appendix B), most occurring after the Jan. 28 order. Threatened escalation to criminal contempt.
  • Praised the DOJ civil-division attorneys who resigned (including “unfortunately, Ana Voss”) and blamed DOJ leadership and “the Administration sending 3000 ICE agents to Minnesota … without making any provision for handling the hundreds of lawsuits.”

Newsletter Relevance

Schiltz is the human-scale figure for the rule-of-law thread under the institutional-breakdown story: a Republican-appointed chief judge (appointed by George W. Bush) driven to threaten criminal contempt against the executive branch — repeatedly — to force compliance. His “ICE is not a law unto itself” framing is the cleanest available articulation of the stakes, and his orders are the primary-source counterweight to the Enforcement Theater narrative.

Quotes

“ICE has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence. … ICE is not a law unto itself.”

“The Court is not aware of another occasion in the history of the United States in which a federal court has had to threaten contempt—again and again and again—to force the United States government to comply with court orders.”
